Senior Health Medicare Insurance Premium Stimulus Sweepstakes 2020/2021

1. NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
2. The Senior Health Medicare Insurance Premium Stimulus Sweepstakes 2020 will award five (5) lucky winners up to $1,000 USD cash prize for payment towards 2021 annual health insurance premiums. Entrants can enter the sweepstakes by submitting Referral(s) to the Sponsor, Senior Health Medicare, until Apirl 15, 2021. After which, the Sponsor will randomly draw five (5) winners. This Promotion will be construed and evaluated only according to applicable laws within the United States. The Promotion begins at or about September 1, 2020 at approximately 9:00 a.m. Eastern Time “ET”) and ends on April 15, 2021 at or around 12:00 p.m. ET ("Promotion Period").
3. Eligibility : The Promotion is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age or the age of majority in their state of residence. Employees of the Sponsor, Senior Health Medicare, and of each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees and the immediate family of each such employee, and all individuals (including, but not limited to, consultants, independent contractors, so-called “temporary employees,” former employees and interns) who have, within the past six months, performed services for Sponsor, are not eligible to play or win. “Immediate family” members include spouses, grandparents, parents, children and grandchildren, whether by marriage, past marriages, remarriage, adoption, cohabitation or other family extension. Non-eligibility will result in disqualification. An entry submitted by an ineligible person is void, and cannot be a winning entry.
4. How to Enter: To enter the Promotion, you must submit the name, phone number, and email address, if available, of a Medicare-eligible person “Referral.” One (1) entry is awarded to you for every valid Referral submitted. Validity will be independently confirmed via intelius.com. Referrals cannot be past or current clients of Senior Health Medicare. Duplicate Referrals received during the Promotion will only count as one (1) entry and be awarded to the first entrant to submit that Referral. No purchase by Referral necessary to qualify as a valid entry. Individuals whose names are submitted as Referrals are not automatically admitted to win the prize. Individuals whose names are submitted as Referrals are eligible to also play, submitting entries as outlined below. 10 entry maximum. Each Referral will be contacted via email or telephone by Senior Health Medicare to inform them. Entries may be submitted in the following ways during the Promotion Period:
   
   a. VIA WEB FORM: Visit https://www.seniorhealthmedicare.com/Sweepstakes. You will be asked to provide your basic contact information, including name, address, and phone number. You will then be prompted to enter the name, email address, and phone number for each Referral for your entries.
   
   b. VIA MAIL: Fill out your name and the name, email address, and phone number of your Medicare-eligible Referral(s) on the back of the official Raffle Sweepstakes Mailer card and mail to: Senior Health Medicare c/o Raffle Sweepstakes 39475 13 Mile Rd. Ste 203, Novi, MI 48377. Each valid name submitted will count as one (1) entry, even if multiple names are submitted on the same card.
   
   c. ALTERNATIVE MAIL ENTRY. Write and mail a letter with your name, mailing address, e-mail and phone number indicating your desire to enter the sweepstakes and requesting the amount of entries you desire, up to 10. Mail the letter to Senior Health Medicare c/o Raffle Sweepstakes 39475 13 Mile Rd. Ste 203, Novi, MI 48377.
5. Prizes: Five (5) cash prizes. Each winner will receive up to $1,000 USD cash, unless the annual sum of the winner’s health insurance is less than the prize amount. The cash prize amount will be determined based on a letter from the winner’s insurance company, verifying their premium amount. “Insurance premium” as used in this promotion may refer to any type of medical insurance coverage, and is not exclusive to major medical coverage. A minimum number of 1,000 valid entries must be received in order for a prize to be drawn. The minimum cash prize is $1,000 USD pre-taxes. Taxes, if any, are the sole responsibility of the winner.
6. Winning: The winning entrants will be randomly determined by an algorithmic computer randomization program. If you are drawn as a winner, you will receive a “winner” email and phone call with instructions on how to claim your prize. Limit one prize per household.
   
   a. Odds of Winning: The odds of winning a prize depend on the number of eligible entries submitted during the promotion period and the number of entries submitted per entrant.
7. Claiming Prize: Potential winner must respond within 72 hours to the notification email and/or call. Winners will be required as instructed in the “winner” message notification to complete, sign and return an Affidavit of Eligibility, Waiver of Liability or a Prize Acceptance, Eligibility, Liability Release Forms, and except where prohibited by law, Publicity Release Forms within 14 days of receipt of forms by Certified Mail or prize may be forfeited (TN residents need not sign the publicity releases). Each winner with a prize ARV of $600 or more must complete Form W-9.
   
   a. If required by law, an IRS 1099-MISC Form will be prepared in the winner’s name and submitted to the IRS for the value of the winner’s prize. Sponsor will cause a copy of any submitted 1099-MISC Form to be sent to winner’s last known address. In the event of noncompliance with these Official Rules, if prize notification or attempted notification is returned as undeliverable, if Sponsor does not receive a timely response to prize notification, if prize winner fails to complete and return required documents by deadline set by Sponsor, or if a prize winner declines prize offered, prize will be forfeited, and prize will go un-awarded. By participating in the Promotion, all entrants acknowledge compliance with and agree to be bound by these Official Rules, and the decisions of Sponsor and/or judges, which are final in all respects. The potential prize winners must meet all eligibility requirements set forth in these Official Rules to receive prize.
   
   b. If potential winner does not respond within the timeframe stated in the “winning” message, if potential winner is not in compliance with the Official Rules, if potential winner does not meet the eligibility criteria, or if potential winner does not sign and/or return required documentation by deadline set by Sponsor, prize may be forfeited, and prize will go un-awarded.
8. Termination: If, for any reason (including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of the Promotion Entities that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Promotion), the Sponsor cancels, terminates, modifies or suspends this Promotion, Sponsor will not select prize winners for any remaining Promotion Period and will close the Promotion. If Sponsor does so, Sponsor will post notice of its action at our website https://www.seniorhealthmedicare.com
9. Personal Information: Any personal information supplied by you to the Sponsor will be subject to our privacy policy posted at https://www.seniorhealthmedicare.com/privacy-policy. By participating in the Promotion, you authorize Sponsor to communicate with you by email and telephone in connection with the Promotion. By providing the contact information of your Referrals, you assume all responsibility for informing the Referral of the collection of their contact information by the Sponsor. You consent to our using your name as the referral source when contacting Referrals you have provided.
10. General: By accepting a prize, the winner grants to the Promotion Entities the right to use winner’s name, likeness, image, voice, hometown and biographical information in advertising, trade and promotion, including on the Internet or via wireless application protocol, without further notice, compensation or permission, except where prohibited by law. Government employees who win a prize may be subject to ethics and gift rules of their jurisdiction.
    
    By playing, entrants agree to release, waive and hold harmless Sponsor from any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney’s fees) resulting from the entrants’ participation in this Promotion, their acceptance, use, or misuse of any prize or element thereof, and any travel or event-related activity in connection with the Promotion. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules or the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is a conflict between any term of these Official Rules and any entry or marketing materials used in connection with this Promotion, the terms of the Official Rules will govern.
    
    Sponsor reserves the right to disqualify any individual from further participation in the Promotion if Sponsor concludes, in its sole discretion, that such person: (a) has attempted to tamper with the entry process or other operation of the Promotion; (b) has disregarded or has attempted to circumvent these Official Rules; (c) has committed fraud or attempted to undermine the legitimate operation of the Promotion; or (d) has acted toward any Promotion Entity or any other entrant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter more than the number of times permitted herein, including through the use of any prohibited device or method.
    
    By participating in the Promotion, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any prizes awarded, will be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards in your favor will be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Promotion but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to, claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses.
    
    This Promotion will be governed by the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. Venue for any action concerning the Promotion or these Official Rules will be in the state courts of Michigan or federal court located in Michigan.
11. Winners List: You may request the names of winners by sending a self-addressed, stamped envelope with the name of the Senior Health Medicare Insurance Premium Stimulus Sweepstakes 2020 on the envelope and addressed to: 39475 Thirteen Mile Rd., Ste 203, Novi, MI 48377. Requests must be received no later than March 31, 2021.

13. PARTICIPANT IRREVOCABLY WAIVES ALL CLAIMS AGAINST SENIOR HEALTH MEDICARE AND ITS ENTITIES AND AGREES THAT THE SENIOR HEALTH MEDICARE ENTITIES WILL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THIS PROMOTION OR THE PRIZES AWARDED.
